Beta Tester Terms and Condition (For the App)

This Agreement is between the individual (“Tester”) who has received specific login credentials from a member of the Xerberus organization and Xerberus. The provision of login credentials grants the Tester a limited, revocable, non-exclusive right to access the Xerberus Platform for closed beta testing purposes (“Closed Beta”).

1. Acceptance of Terms:

By logging into the Closed Beta using the provided login credentials (“Login Credentials”), Tester agrees to abide by the terms and conditions
set forth herein (“Terms”). These Terms form a binding legal agreement between Tester and Xerberus.

2. Confidentiality:

(I) Tester acknowledges that all information, data, and content viewed or accessed on the Xerberus Platform during the Closed Beta, including but not limited to risk ratings and visual displays, are confidential (“Confidential Information”). Tester agrees to maintain the confidentiality of the Confidential Information and not to disclose or share it with any third party without the express written consent of Xerberus.

3. Beta Stage Acknowledgment:

(II) Tester acknowledges that the ratings and other outputs generated by the Xerberus Platform are in a technological beta stage (“Beta Stage”). Products and services in Beta Stage are inherently unreliable, and may undergo significant changes before achieving reliable operation. Tester understands that the use of the Xerberus Platform during the Closed Beta is at Tester’s own risk.

4. Disciplinary Measures:

(III) Tester acknowledges that any unauthorized sharing or distribution of Confidential Information from the Closed Beta may result in disciplinary measures, up to and including legal action. Disciplinary measures will be pursued at the sole discretion of Xerberus, and may include termination of Tester’s access to the Closed Beta and other Xerberus services.

This Agreement constitutes the entire agreement between Tester and Xerberus with respect to the Closed Beta, and supersedes any prior agreements, discussions, or representations regarding the Closed Beta. By logging into the Xerberus Platform using the Login Credentials, Tester acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement.

Xerberus reserves the right to amend or update these Terms at any time without notice. Tester’s continued participation in the Closed Beta constitutes acceptance of any modifications to these Terms.
